1. Account Setup
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.
2. Account Use
Host Affection™ does not allow any of the following content to be hosted:
a) Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
b) Adult Material - Includes all pornography, erotic Images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Host Affection™.
c) Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
d) Other Material - Any material we feel to be abusive, effect or could effect the operation of the service and/or effect other internet users. The designation of "abusive" is left entirely to the discretion of Host Affection™. All rights reserved.
3. SSH
We offer SSH on all of our plans, but due to security reasons, it is not installed alternatively. We must have receive a valid reason for needing SSH before it is installed on your account.
4. Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, commonly known as spam. Any user who sends out spam will have their account terminated without notice.
Host Affection™ reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion.
Host Affection™ also reserves the right to make any such modifications in an emergency at our sole discretion.
Host Affection™ reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Host Affection™. All rights reserved.
5. Payment Information
You agree to supply appropriate payment for the services received from Host Affection™, in advance of the time period during which such services are provided. You agree that until and unless you notify Host Affection™ of your desire to cancel any or all services received, those services will be billed on a recurring basis.
6. Backups and Data Loss
Host Affection™ maintains a Daily Backup that is created every night. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the client's responsibility to maintain local copies of their web content any information.
The "Backup Manager" is included in each Hosting Account Control Panel and clients can use this tool to create a backup of all data. If loss of data occurs due to an error of Host Affection™, we will attempt to recover the date for no charge to the client. If data loss occurs due to negligence of client in securing their account or by an action of the client, Host Affection™ will attempt to recover the data from the most recent archive for a $50.00 fee.
7. Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages; the fee will be $2 per GB per month unless otherwise negotiated. Unused transfer in one month cannot be carried over to the next month.
8. Cancellation and Refunds
Each of Host Affection™'s web hosting plans carries a 15 day unconditional money back guarantee on them. If you are not completely satisfied with our services within the first 15 days of your service, you will be given a full refund of the contract amount. All accounts will come with a 15 day moneyback guarantee even if they have gone through a trial period.
No refund is available after the 15th day for our services.
Refunds will strictly not be given to any user that fails to comply with our policies.
Any chargebacks will automatically cause your hosting account to be terminated and the proper authorities to be contacted. By law and our policies, you CAN NOT get a charge back on our services through your bank or card provider. You MUST come through Host Affection™, and we will refund your money. If you get a charge back with no reason, you will be charged an additional $50 per incident and the matter will be forwarded to our collections agency.
Accounts cancelled/terminated by Host Affection™ do not qualify for the 15 day money back guarantee. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.
Host Affection™ has a zero-tolerance policy as far as credit card fraud is concerned. If you knowingly misuse your own credit card and perform chargeback after using your hosting for a full period then be advised that Host Affection™ will take full legal action. This includes a court hearing where the sole arbitrator will be a judge (without a jury). You will also be liable to pay for attorney fees for Host Affection™ and as well as any damages caused by you to Host Affection™. We take fraud very seriously and have taken action against such cases before and will do it again if required.
9. Price Lock Guarantee
Once customer has signed up for Host Affection™'s services under a plan, the price of the plan will not change for the customer even if prices on the Host Affection™ website have gone up or down.
10. 99.5% Uptime Guarantee
Host Affection™ offers a 99.5% uptime guarantee. Host Affection™ guarantees that customer sites will not be down for more than .5% a month. This roughly calculates to about 216 minutes a month of downtime. Host Affection™ cannot be liable for anything that may occur due to these minutes of downtime. If customer's site is down for more than .5%, pricing for the next month can be negotiated.
11. Overselling Policy
Host Affection™ allows our clients to oversell their reseller account. If we feel that a client's reseller account is too oversold, then we have the right to upgrade that account, through consultation with the client. This policy is to prevent the abuse of resources through Host Affection™ clients overselling their resources and causing harm to others on the same server.
12. Banned Scripts
Host Affection™ does not allow the use of the following scripts on our servers.
- AlienForm
- FormMail.pl
- Greymatter
- Ikonboard
- IRC Egg Drops & IRC related programs.(chat software)
- lstmrge.cgi
- Proxy Servers & Scripts (EX: nph-proxy)
- Shell, SSH, Telnet Scripts and Shell, SSH, Telnet Alternatives
- The Anonymizer
- UltimateBBS
- YABB + YABB SE
- Chat rooms not included as standard in the cPanel
13. Unlimited Data/Transfer Policy
Host Affection™ reserves the right to refuse or disconnect services to those clients to use Host Affection™ Reseller Accounts to promote "Unlimited Disk Space & Unlimited Data Transfer" hosting accounts. We take this policy very seriously and have no hestiation to refuse or disconnect service for those that breach this policy.
14. No Free/Demo Accounts
We forbid our resellers from setting up Free Trial or Demos Accounts. These open our servers up to severe abuse from spammers and hackers. If we find resellers who are offering Free Trial accounts or Demo accounts, we will suspend your Reseller account. We take this policy very seriously and have no hestiation to refuse or disconnect service for those that breach this policy.
15. Rollover Bandwidth
Host Affection™ makes rollover bandwidth available on our dedicated servers. Bandwidth can only be rolled over on a month-to-month basic. After 3 months your unused bandwidth expires and can no longer be used.
16. Indemnification
Customer agrees that it shall defend, indemnify, save and hold Host Affection™ harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Host Affection™ , its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Host Affection™ against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Host Affection™' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Host Affection™ server.
17 Disclaimer
Host Affection™ will not be responsible for any damages your business may suffer. Host Affection™ makes no warranties of any kind, expressed or implied for services we provide. Host Affection™ disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Host Affection™ and its employees.
18. Changes to the Policy
Host Affection™ reserves the right to revise its policies at any time without notice.
